Terms of Use
These Terms of Use (“Terms”) govern your use of the Malvi mobile application (“Malvi”, the “App”). Malvi is developed and operated by Nazarii Kalinchuk, an individual developer based in Ukraine (“we”, “us”). By downloading or using the App, you agree to these Terms. If you do not agree, please do not use the App. Our Privacy Policy explains how we handle your information.
1. License
We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on any Apple-branded products that you own or control, for your own personal, non-commercial use, in accordance with these Terms, the Apple Standard EULA and the usage rules in the Apple Media Services Terms and Conditions (see Section 13 below).
2. Eligibility
The App is intended for adults and is rated 18+ on the App Store. By using it you confirm that you are at least 18 years old (or the age of majority in your jurisdiction, if that is higher). Partner connection is only for two adults who are a couple and who both agree to connect (Section 4).
3. Subscriptions and payments
Malvi offers an optional auto-renewable subscription, Malvi Pro (“Pro”), that unlocks additional content and features. Prices and billing periods are shown in the App before you buy. Key terms:
- Payment is charged to your Apple ID account at confirmation of purchase.
- If a free trial is offered, it turns into a paid subscription automatically at the end of the trial, unless you cancel at least 24 hours before the trial ends.
- If a free trial is offered, any unused portion is forfeited when you purchase a subscription.
- The subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
- Your account is charged for renewal within 24 hours prior to the end of the current period.
- You can manage or cancel your subscription in your Apple ID account settings after purchase.
All purchases are processed by Apple. Refunds are handled by Apple in accordance with its policies.
If you are connected with a partner, a Pro subscription bought by one of you also unlocks Pro for the other (Section 5). Deleting the App, resetting your data or deleting your connection data does not cancel your subscription.
4. Partner connection
Partner connection is an optional feature that links your Malvi app with your partner's, so that you can share Pro, send each other drawings, play quizzes each on your own phone and keep a shared Flame (your daily streak). You don't need it to use the rest of the App. It uses an anonymous account (no email, phone number or password) that the App creates for you as soon as you tap to invite a partner, enter a code or open an invite link, even if you stop before connecting. It also stores some of your details on our servers, as described in our Privacy Policy.
- Only for couples. Partner connection is only for two adults who are in a relationship with each other and who both want to connect. Do not use it to connect with a minor, a stranger or anyone who has not agreed to it. On the screens where you create or share an invite code or join with a code, the App shows a line saying that by continuing you accept the connection rules and these Terms, with links to both. By sharing your invite code or joining with a code, you accept them. The connection rules are a short summary; if they differ from these Terms, these Terms apply. You can read the connection rules again later: Menu tab → Us card at the top → More → Connection rules.
- One partner at a time. You can be connected with only one partner at a time. To connect with someone else, disconnect first. If your partner moves to a new phone, you can create a code for that phone (Menu tab → Us card → More → “Partner changed phone?”). It moves the connection to the new phone, and the old phone is disconnected.
- Invite codes. To connect, one of you creates an invite code, which can also be shared as a link or QR code, and the other enters it or opens the link. Codes are personal and single use: share yours only with your partner. A code expires after 7 days (60 minutes for a code that moves the connection to a new phone) and stops working once it is used, when you create a new one, or when you disconnect or delete your connection data. How often codes can be created and entered is limited: after several wrong codes you have to wait before trying again, and a code stops working after repeated attempts to use it by someone who is blocked. Anyone who has your code can see your first name before connecting, so if someone who is not your partner gets it, create a new code. If you are connected with someone by mistake, disconnect right away.
- What your partner can see. Your partner can access the name you entered in the App (for example, your first name or a nickname), your app language and type of device; the relationship start date, statuses and goals you share, which either of you can change; the drawings you send and when you viewed theirs; your answers in quizzes you play on two phones; the days you counted for the shared Flame, with your best run and total; whether notifications from them can reach you; and which of you pays for Pro. Other users cannot see this information, except your first name, which anyone who has your code can see before connecting.
- Quizzes and the shared Flame. When you are connected, you can play a quiz each on your own phone. Your answers reach your partner's app as soon as you send them, and each of you sees the other's answers in the quiz result once you have both answered. Some quizzes are about intimacy, so answer them only if you are comfortable with your partner seeing your answers. To play on one phone without sending your answers, choose “Partner is right here”. If your partner has not answered a round for a week, you can cancel it when you open that quiz, which deletes the round together with your answers. While you are connected, your Flame is shared: a day that either of you counts keeps it going for both of you.
- Disconnecting and blocking. Either of you can disconnect at any time: open the Menu tab, tap the Us card at the top, then More in the Connection section, then Disconnect. When you disconnect, your partner is told that the connection ended, their drawings disappear from your app, you stop receiving each other's drawings, quizzes and notifications, the Flame is no longer shared, and the partner who does not pay loses shared Pro right away (Section 5). Data kept only on your phone stays. In the same step you can choose Disconnect and block: your partner is then not sent a notification and sees that the connection ended the next time they open the App, and the App will not connect you with that partner's connection account again until you unblock them (Menu tab → Us card → More → Unblock partner) or delete your connection data. After you report a drawing, the App also offers to block your partner (Section 6).
- Deleting connection data. You can delete your connection data in the App at any time (Section 7).
5. Pro shared with your partner
If one of you has an active Pro subscription (including a free trial) while you are connected, the other partner also gets Pro at no extra cost. Shared Pro works only while that subscription is active and the two of you stay connected. It ends for the partner who does not pay:
- right away when either of you disconnects, blocks the other or deletes connection data;
- when the subscription is no longer active, for example when it ends after being cancelled or when Apple refunds it.
Only the partner who bought Pro is charged, and only they can manage, change or cancel the subscription, in their own Apple ID account settings. The other partner cannot manage or cancel it, and only the paying partner can ask Apple for a refund, under Apple's policies. Both of you can see in the App which of you pays. If each of you has your own subscription, both continue separately and each is billed to its owner; connecting does not cancel, merge or pause them, and if one of them ends, the other can cover both of you.
Shared Pro is limited to one connected partner, is not a separate purchase and cannot be transferred. Changes to the subscription can take a short time to reach your partner's app. If the paying partner moves to a new phone, they may need to restore purchases in the App to keep sharing Pro.
6. What you share and community rules
When you are connected, you can send drawings to your partner. They appear in your partner's app and, if they have added it, on their Malvi drawing widget, and your partner may get a notification that shows your name. A drawing can stay visible in your partner's app and on their widget for up to 90 days after you send it, as described in our Privacy Policy. Your quiz answers and the other details you share through partner connection are shown to your partner as described in Section 4.
Your drawings. You own the drawings you create. By sending a drawing, you give us a non-exclusive, worldwide, royalty-free license to store, copy, transmit and display it only as needed to deliver it to your partner and their widget, to run partner connection, including reviewing reports, and to comply with the law. We do not use your drawings for any other purpose, such as advertising or analytics. This license ends when all copies of the drawing are deleted from our servers, including any copy kept with a report or in backups, as described in our Privacy Policy. You are responsible for what you send, and you must have the right to share it.
Your quiz answers and Flame days. We store them and share them with your partner only to provide quizzes on two phones and the shared Flame, and we look at them only as described in our Privacy Policy, for example to answer your request or fix a technical problem. Our analytics receive events about them, such as whether your answers matched or that a day was counted, but not the answers themselves.
Prohibited content. We have zero tolerance for objectionable content and abusive users. Anyone who sends such content or abuses partner connection will have the content removed and may lose access to partner connection. These rules apply to everything you share with your partner in Malvi, including your drawings and the name you enter. Do not send drawings or use partner connection for:
- illegal content, or content that promotes illegal activity;
- harassment, bullying, insults or intimidation;
- threats of violence or harm;
- hate: content that attacks or demeans people based on race, ethnicity, national origin, religion, disability, sex, sexual orientation, gender identity or a similar characteristic;
- any content that sexualizes, exploits or endangers minors;
- intimate or sexual images of a real person shared without their consent;
- spam, advertising or other unwanted commercial content;
- content that infringes someone else's copyright, trademark, privacy or other rights.
Your tools. Drawings, quiz answers and notifications about your partner can only come from the one partner you chose to connect with using a one-time code. No one else can send you content in Malvi. On any drawing you receive, you can:
- Hide it: this removes it only from your own phone, including your widget. Your partner is not told.
- Report it and choose a reason, for example offensive content or that the sender is not your partner: the drawing is removed from your pair right away, so it no longer appears in either of your apps or on the widget. We keep a copy in the report record on our servers for 30 days so that we can review it, and then it is deleted automatically. The sender is told that one of their drawings was removed after a report.
Reports apply to drawings. Quiz answers are choices and ratings, not your own words, so they cannot be reported. If anything else your partner does in the App bothers you, you can disconnect or block them and contact us.
You can block your partner at any time: open the Menu tab, tap the Us card at the top, then More in the Connection section, then Disconnect, and choose Disconnect and block (Section 4). After you report a drawing, the App also offers to block your partner. The App will then not connect you with that partner's connection account again (Section 4).
How we handle reports. We act on every report within 24 hours: the reported drawing is removed automatically as soon as the report is sent. We are also notified of every report, and we review it and take further action if needed. If we find that someone broke these rules, we may remove their content, disconnect their pair, restrict or suspend their access to partner connection, or disable their connection account, and we may report illegal content to the authorities where the law requires it. If you think your drawing was removed or your access to partner connection was restricted by mistake, contact us (Section 15) and we will review it.
Contact us about objectionable content. You can also tell us about objectionable content or behavior by email at nazariy2410@gmail.com or with Contact Support in the Menu tab of the App or in the connection rules. We act on these messages within 24 hours as well.
7. Deleting your connection data
Malvi does not require an account. If you used partner connection, even if you only created a code or opened an invite, you can delete your connection data at any time in the App: open the Menu tab, tap the Us card (your couple profile) at the top, then More in the Connection section, then Delete connection data. This disconnects you from your partner, deletes your anonymous connection account, deletes from our servers the drawings you sent, your quiz answers, your Flame days and the reports you filed, and ends the Pro your subscription shared with your partner. If you pay for Pro, the App first reminds you that this does not cancel your App Store subscription. Some data is kept for a limited time, and anything already saved on your partner's phone is not affected, as explained in our Privacy Policy.
Deleting connection data does not remove the details stored only on your phone (you can remove them with Reset progress and start over in the Menu tab or by deleting the App), and it does not cancel your App Store subscription. Resetting your data or deleting the App does not delete your connection data from our servers or disconnect you: after a reset, or after reinstalling the App on the same phone, your connection is restored. Use Delete connection data for that. For any other request about your data, see the Privacy Policy or contact us with your support code (Section 15).
8. Acceptable use
You agree not to misuse the App, including attempting to reverse-engineer it, disrupt its operation, or use it for any unlawful purpose. You also agree not to try to access another person's account, pair or data, guess or collect invite codes, get around limits on codes, drawings, quizzes, reports or shared Pro, or use partner connection to harass, pressure or deceive anyone.
9. Content and disclaimer
Malvi provides questions, quizzes, prompts, and date ideas for entertainment and connection between partners. Some content is intended for mature audiences. The content is not professional, medical, legal, or relationship advice, and is provided “as is” without warranties of any kind.
Drawings and quiz answers are created and sent by users, not by us, and we do not review them before they are delivered. We are not responsible for them, but we act on reports as described in Section 6. Partner connection, drawings, quizzes on two phones, the shared Flame, notifications and widget updates depend on your internet connection, your phone's settings and third-party services, so they may sometimes be delayed or unavailable.
10. Intellectual property
The App, its content, design, and branding are owned by us or our licensors and are protected by applicable intellectual-property laws. You may not copy, distribute, or create derivative works without permission, other than through the sharing features the App provides. Your drawings belong to you (Section 6).
11. Changes to the App, suspension and termination
We may change, add or remove features and content of the App, change which features are free or part of Pro, and set limits on features, for example on drawings, quiz rounds or notifications. We may also pause partner connection, drawings or quizzes on two phones for everyone for a while, for example for maintenance or security.
We may restrict, suspend or end your access to partner connection, drawings, quizzes on two phones or shared Pro, without prior notice where needed, if you break these Terms (in particular Section 6), if the law requires it, or to protect your partner, other people or the App. This does not cancel a subscription you bought with your own Apple ID; you can manage it in your Apple ID account settings.
You can stop using the App at any time: disconnect, delete your connection data (Section 7) or delete the App. If you stop using the App, or if we end your access to it under these Terms, your license to use the App ends, and the sections that by their nature should continue, such as Sections 9, 10, 12 and 13, continue to apply.
12. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the App, including content sent to you by another user or the loss of drawings, quiz answers, Flame days or other data. Except for refunds from Apple (Sections 3 and 13) and the rights described in the next paragraph, your sole remedy for dissatisfaction with the App is to stop using it.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, or takes away rights you have under the mandatory consumer protection laws of the country where you live.
13. Apple App Store terms
Malvi is distributed through Apple's App Store, so your use of the App is also governed by Apple's Licensed Application End User License Agreement (the “Apple Standard EULA”) and the Apple Media Services Terms and Conditions. These Terms supplement the Apple Standard EULA and add rules for Malvi's own features, such as partner connection, drawings, quizzes on two phones and shared Pro. If these Terms and the Apple Standard EULA conflict, the Apple Standard EULA applies to the extent of the conflict. The “Terms of Use” link on the Pro purchase screen opens the Apple Standard EULA, and the “Terms” links in the Menu tab, in the connection rules and on the screens where you create or share an invite code or join with a code open these Terms. Both apply to you.
- These Terms are between you and us only, not Apple. We, not Apple, are solely responsible for the App and its content.
- We are solely responsible for providing any maintenance and support for the App, as described in these Terms or as required by law. Apple has no obligation at all to provide maintenance or support for the App. For support, contact us (Section 15).
- We, not Apple, are solely responsible for any product warranties, whether express or implied by law, to the extent they are not effectively disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, for the App. To the maximum extent permitted by law, Apple has no other warranty obligation for the App. Any other claims, losses, liabilities, damages, costs or expenses caused by any failure to conform to a warranty are our sole responsibility.
- We, not Apple, are responsible for handling any claims by you or anyone else relating to the App or your use of it, including product liability claims, claims that the App does not meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
- If anyone claims that the App or your use of it infringes their intellectual property rights, we, not Apple, are solely responsible for investigating, defending, settling and discharging that claim.
- You confirm that you are not located in a country that is subject to a U.S. Government embargo or that the U.S. Government has designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- When using the App, you must also follow any third-party terms that apply to you, such as your mobile carrier's terms.
- Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce them against you as a third-party beneficiary.
14. Changes to these Terms
We may update these Terms from time to time. Continued use of the App after changes take effect constitutes acceptance of the updated Terms. The date of the latest version is shown at the top of this page, and for material changes we may also let you know in the App. If these Terms are available in other languages, the English version applies.
15. Contact
Questions about these Terms? Email us at nazariy2410@gmail.com, or use Contact Support in the Menu tab of the App. Contact Support opens an email to us with your support code and technical details about the App, which you can review and edit before sending, as described in our Privacy Policy. Malvi has no accounts with names or email addresses, so if you write to us another way, please include your support code, which is shown at the bottom of the Menu tab next to the app version. Malvi is operated by Nazarii Kalinchuk, an individual developer based in Ukraine. Use the same address for support, to tell us about objectionable content or behavior, and for any questions, complaints or claims about the App.
